Terms & Conditions

GENERAL

The following terms and conditions apply to every offer, quotation, acceptance and contract for the supply or sale of goods by Beaumont & Fletcher Ltd. No change to these terms and conditions shall be deemed to be part of the contract unless agreed to in writing by Beaumont& Fletcher first. Your statutory rights are not affected by these conditions.

PAYMENT

A non-refundable deposit of 50% of the order value and 100% payment for non-Beaumont & Fletcher goods is required at the point of order. The full price must be paid and cleared prior to delivery. Fabric orders are payable in full at the point of order. All prices are inclusive of VAT unless otherwise stated and can be paid via all major debit and credit cards.

TRADE ACCOUNTS

Beaumont & Fletcher reserves the right to deny opening a trade account or
remove a trade status at any time. Trade accounts will be opened on a proforma basis until Beaumont & Fletcher agrees to change this to credit status.

PRICING

Beaumont & Fletcher Ltd reserves the right to change prices if they deem it necessary on all orders and quotes at any time. Prices given over the phone and on our price lists are for guidance only, and will vary depending on the exact requirements. All prices shown on the website and in brochures are inclusive of VAT. Delivery charges are clearly highlighted in quotes and invoices.

LEAD TIMES

The time required to create a product is dependent on complexity and quantity, and can vary from month to month. Approximate lead-times will be quoted on every order, but can sometimes change beyond our control. Any promise made, whilst done so in good faith, is not guaranteed and we shall not be liable for the consequence of a delay. Intermediary agents shall be deemed to be the agent of the purchaser. Title and risk of the goods shall only pass to the customer on delivery.

DELIVERY

Delivery is an additional charge, which is clearly highlighted in quotes and invoices, and subject to change due to fluctuating transport costs.

ACCEPTANCE OF GOODS

It is the responsibility of the customer to ensure suitable access for larger goods, such as furniture. If a bespoke item does not fit on delivery the customer will still be charged. Beaumont & Fletcher is unable to accept any such item back. It is the customer’s responsibility to advise of any potential access issues so that suitable plans can be put in place. The delivery charge does not cover the removal of any doors or windows to allow the free passage of the goods to a certain location. If packaging shows signs of damage it must be noted on the delivery slip. All goods must be unpackaged and checked within 48 hours and any damage notified in writing immediately along with images. In the case of any damage the customer must not discard the packaging. Where the customer accepts or has been deemed to accept any goods, Beaumont & Fletcher will have no liabilities in respect of those goods. The customer shall be deemed to have accepted the goods following successful delivery.

PRESENTATION OF FINISHED GOODS

Due to the handmade nature of our products, all items are unique and may differ slightly from the items shown in terms of both colours and size.It is not always possible to achieve exact precision of measurements and we expect a certain degree of tolerance. All sizes are approximate and sometimes colours can vary visually due to photographic means and other online publishing processes. It is the responsibility of the purchaser to check suitability before placing an order. Reasonable allowance must be made for any slight difference in the finished product. Fabric colours may vary from batch to batch. For a perfect colour match we suggest a client orders a cutting for approval.

OWNERSHIP

Title to, and ownership of the relevant goods remain the absolute and unencumbered property of Beaumont & Fletcher Ltd, until payment in full is received.

LIABILITY

All goods are supplied by us on condition that our liability for any fault or defect in the quality, condition description or fitness for any purpose, is limited in amount to the sum not exceeding the purchase price of the goods. Under no circumstance, shall Beaumont & Fletcher be liable for indirect or consequential loss or damage.

COPYRIGHT AND SALE

All samples and designs supplied by Beaumont & Fletcher, arc protected by UK and International copyright and other intellectual property laws. Designs remain the property of Beaumont & Fletcher even after they are sold. Any unauthorised reproduction or copying of the products or images belonging to Beaumont & Fletcher may result in legal action. Orders arc accepted, and goods and samples supplied on the contractual understanding that they will not be offered for resale, either directly or indirectly. They shall not under any circumstances be sold other than as a Beaumont & Fletcher product.

ERRORS & OMISSIONS

Every effort has been made to provide accurate product information on the website, price lists, brochures, and texts, but no guarantee may be taken or inferred as to their absolute accuracy and Beaumont & Fletcher Ltd accepts no liability for any errors or omissions.

GUARANTEE

Our products are guaranteed for 10 years from the date of delivery against faulty workmanship and materials. This guarantee does also not cover distaste in the overall look, third party products, fair wear and tear, neglect, abuse or misuse of goods, loss or damage (including rusting and corrosion) due to unreasonable exposure to water, heat or weather; loss or damage due to fire, smoke, explosion, lightning, sunlight, infestation by animals or boring insects, damage by animals generally, theft and accidental damage or loss caused by a third party. By placing an order with Beaumont & Fletcher, you will be deemed to have read, understood and agreed to the following terms and conditions.

DAMAGES

Every effort is made to ensure products arrive in perfect condition but can veryoccasionally be damaged.
If packaging shows signs of damage it must be noted on the delivery slip. All goods must be unpackaged and checked within 48 hours and any damage notified in writing immediately along with images. In the case of any damage the customer must not discard the packaging. We cannot accept liability and no claim can be made if products are used, installed or altered in any way. This also applies to any changes in appearance, performance, or defects in any of our products, if they are treated after purchase, by spraying or processing or any kind, including flame proofing or the application of stain repelling treatments.

CLAIMS

We will not be liable for any direct or indirect loss of profits of other financial loss or damage arising out of defective, damaged, or wrongly delivered goods, over and above the value of the actual goods themselves supplied by us. In the event of an accepted claim we will endeavour to repair the defective goods. If a repair is not possible we will offer a replacement and if a suitable replacement is not available, we will offer a refund.

CANCELLATION POLICY

Fabrics can be returned in perfect condition within 14 days of purchase, with a restocking charge of 20%. Delivery costs for the safe return of the fabric are the responsibility of the customer.

DATA PROTECTION

We agree to comply with our data protection obligations. Any information provided when placing an order is always held securely. We will not share or sell personal information to any third parties.

FORCE MAJEURE

If Beaumont & Fletcher is prevented from fulfilling its obligations by a cause beyond its reasonable control, including but not limited to extreme weather, natural disaster, industrial action, war or import/export regulations or embargoes we will not be deemed to be in breach of contract. If the contract is delayed or cancelled due as a result of Force Majeure, we accept no liability to compensate for any loss or damage caused.
